Representative cases:

  • Obtained summary judgment for aircraft maintenance facility in defending contract claims related to aircraft repair work, including successful defense in 2016 of appeal to the United States District Court for the Eight District Court of Appeals.
  • Advised aviation insurer on coverage issues, including coverage opinion of plaintiffs’ recovery in aviation-related wrongful death action. 
  • Obtained summary judgment for commercial airline in litigation regarding baggage claim based on federal preemption grounds.
  • Represented commercial aircraft manufacturer in 2009 lawsuit arising from a dispute over an aircraft purchase agreement.
  • Obtained dismissal of commercial airline in litigation arising from a terrorist incident aboard a commercial flight bound for the United States on December 25, 2009. Our attorneys were some of the first approved to represent air carriers with FAA war risk insurance. 
  • Represented commercial airline in litigation arising from 2006 crash while attempting takeoff, which resulted in the death of 47 passengers and two of the three crew members. Key roles involved defense planning strategy, investigation, and development of damage issues and experts in areas including crash survivability and conscious pain and suffering. 
  • Defended pilot in wrongful death cases filed by the estate of a passenger who died in a single-engine plane crash on October 15, 2002. Aircraft crashed when it struck a communications tower on approach.
